1. Acceptance of Terms By accessing the FORTEN website (forten.pro) and engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please refrain from using our website or services.
2. Services Provided FORTEN is an independent agency specializing in digital design, UI/UX architecture, custom web development, brand identity, and motion graphics. Project specifics, including timelines, deliverables, and exact iterations, are determined on a per-project basis and outlined in direct communication with the client.
3. Intellectual Property and Ownership
4. Client Responsibilities The client agrees to provide timely feedback, necessary materials, and clear communication to ensure the project stays within the agreed timeline. Delays on the client's side may result in adjusted project deadlines.
5. Limitation of Liability FORTEN strives for absolute precision and premium quality in all deliverables. However, in no event shall FORTEN be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising out of the use or inability to use our services or final products.
6. Governing Law and Dispute Resolution As an independent, internationally operating agency, these Terms shall be governed by international commercial standards. Any disputes arising out of or relating to these Terms or our services shall first be addressed through good-faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to binding international arbitration, conducted in the English language, excluding the jurisdiction of any specific local courts.

- Preliminary Concepts: FORTEN retains all rights, title, and interest in and to all preliminary concepts, unused drafts, and underlying methodologies developed during the creative process.
- Final Deliverables: Upon full and final payment for the agreed-upon services, the intellectual property rights to the final, approved deliverables are transferred to the client.
- Portfolio Rights: Unless a Non-Disclosure Agreement (NDA) is explicitly signed before the project commences, FORTEN reserves the perpetual, non-exclusive right to display the final work, project case studies, and drafts in our portfolio, website, and social media channels for promotional purposes.
